Developer Contributions

Introduction

Policy 3.3 of the Stirling Local Development Plan 2018 (LDP) allows the Council to seek funds from developers to mitigate the potential impact of their developments on existing infrastructure in relation to education, active travel and transportation, healthcare, waste management, and open space and maintenance.

Policy 2.2 of the LDP sets out the circumstances in which affordable housing provision will be required in relation to new residential development schemes, which is also covered in the draft Statutory Guidance.


Purpose of Draft Supplementary Guidance - Developer Contributions (Revised) (SG)

The purpose of the SG is to provide more detail on relevant policies in the LDP and to explain how, and in what circumstances, they will be applied in planning decisions. It will thus provide developers with certainty as to their planning obligation requirements in relation to planning applications for new development proposals. Once approved the SG will form part of the LDP.

Please note however the SG does not apply to that part of the Stirling Council area within the Loch Lomond and the Trossachs National Park.

Previous Consultation

The SG, has been the subject of previous public consultation and review. Following consideration of consultation responses, changes made to the SG are deemed to be substantial enough to warrant a further round of public consultation.

  2. The background report to the meeting of Stirling Council’s Environment and Housing Committee on 10 February 2022 (pages 75-212) This includes the following information.
  • Confirmation the SG has been the subject of public consultation and review.
  • A summary of the main changes in the revised draft SG in relation to the previous draft SG.
  • Education Infrastructure - para’s 2.6 -2.8
  • Healthcare Infrastructure - Para’s 2.9-2.10
  • Active Travel and Transportation – 2.11 – 2.12
  • Affordable Housing Para’s 2.13
  • Waste para. 2.14

The report also includes the following appendices:

Next Steps

The consultation will run for 12 weeks commencing Monday 22 August and ending Monday 14 November 2022 .All responses received will be assessed and, where considered appropriate, changes to the SG document will be made to arrive at a finalised document which will be brought back to a future meeting of the Environment and Housing Committee for approval. If approved then finalised SG will then be sent to Scottish Ministers who will have 28 days to consider its contents before being adopted as part of the Local Development Plan.
